70 hold candlelight vigil in front of Wisma MCA (The Sun - 19.11.2009)

KUALA LUMPUR (Nov 19, 2009): About 70 MCA members and members of the public held a candlelight vigil in front of the party headquarters tonight to express their concern and heartache on the state of democracy in the party.

Vigil spokesperson Lai Chee Hoe said Tun Tan Cheng Lock founded MCA not for personal power, nor for any personal prestige or gain but to protect the country’s democracy.

"Of course, (in the) 60 years since its establishment, MCA has made mistakes, but it is utmost important that the party should never forget its founding objectives.

"We want to reiterate that it is not for personal power or prestige; it is for the country and nation," he said.
Lai said the party must believe in democracy because when MCA is void of democracy, it will not be able to convince the people that it will promote and enhance democratisation of the country.

"Sadly, since the Oct 10 extraordinary general meeting (EGM), this is what has been happening. In the eyes of people, MCA’s dignity and reputation is almost gone. MCA is now seen as a joke to the public.

"Dear all, we are just ordinary party members. Some say that a party member carries with him or her the conscience of the party. We are not hoping for anything, but to ask for the favour of our leaders: please save the party’s dignity.

"Dear all, we are here not to support any faction, but simply hope to creating a platform for fellow comrades and members of public who care for the party and share our will to safeguard the party’s democracy. With a candle light each in our hands, we hope to bring back the glow of democracy in MCA.

"With a prayer each in our hearts, we hope MCA will end this turmoil and regain stability in time to create a better tomorrow," he said.

Under the watchful eyes of the police, who gave the group about 30 minutes to conduct the vigil, the participants sang the national and party anthems as well as read out the party regulations.
The gathering was peaceful but after the group dispersed, several individuals put up banners bearing the faces of party president Datuk Seri Ong Tee Keat and deputy president Datuk Seri Dr Chua Soi Lek and words such as "Shameless person keeps hanging onto the deputy post, MCA will never revive" and "The party chief has lost both trust and credibility, the Chinese community loses face".

The banners were displayed for only a few minutes before they were confiscated by the police.
Wanita secretary-general Senator Heng Seai Kie, who turned up after the vigil, said she and other six Wanita central committee members had met Ong in the evening asking the latter to reconsider the decision to drop Wanita chief Datin Paduka Chew Mei Fun from the presidential council.

She said the council needed better representations from the wing and Ong is expected to make an announcement tomorrow.

It was also reported in the evening edition of Sin Chew Daily that according to sources, Prime Minister Datuk Seri Najib Abdul Razak may want to the party to have fresh polls by the end of the year during the annual general meeting to avoid the Nov 28 EGM.

60党员静坐守护马华民主 (Merdeka Review - 20.11.2009)

【本刊朱君明撰述】约60名以年轻人为主的马华公会党员及一些非党员的公众人士昨晚七时半在马华公会总部前举办了一场“守护马华公会民主静坐祈祷会”。

傍晚七时半,身穿黑衣的马华公会党员和一些支持者便陆续在马华公会大厦前聚集。他们除了手持蜡烛,有的还戴上了口罩。

这些出席者包括马青中委张盛闻、马华公会妇女组主席周美芬的新闻秘书蔡凤铃、前总会长黄家定的新闻秘书吴健南、副高教部长何国忠的新闻秘书李荣健、马华公会部落客刘振国、马青总团法律局委员黄贝环及马华公会的党员兼律师赖志豪等。

傍晚7时45分,这场庄严肃穆的祈祷会正式开始。主办当局的发言人首先声明这是一场平静的祈祷会,在会间不得作出对人身攻击、批评性及煽动性的言论,更声明这是一场没有派系之分的集会。

声明马华宗旨是捍卫民主

接着,众聚集者先为马华公会作约30秒钟的祷告。过后,他们开始唱国歌、党歌和宣读党训。晚上八时正,此活动的发言人马华公会登州女青年团主任翁秀秀和赖志豪以中英文宣读当晚的“守护马华公会民主,坚持创党初衷”声明。

值得一提的是,此份声明不断地强调马华公会的民主精神,其中一些精彩的句子包括:

“马华公会的创党宗旨,是要保护国家的民主制度。”

“我要重复:不是个人的权位利益,是民族,是国家。”

“我们呼吁:领袖们,请尊重民主制度!只有这样,马华公会才能得到社会的尊重。只有这样,马华公会才能真正团结一致;我们才能停止这一切荒腔走板的权力斗争和闹剧。”

王赛芝被轰“来做戏”

晚上八时一刻起,全场开始静坐。周围有20余位的警员进行监督,并规定他们必须在8时20分前自行解散。因此,尽管主办当局早前宣称,这祈祷会将在晚上九点才结束,但最后也不得不在警方的催促下提早结束。

静坐祈祷会在8时20分方才结束,新上任的马华公会新闻局主任王赛芝便出现在现场。她的出现掀起了一阵骚动,更有人高喊“王赛芝来做戏!”以及“王赛芝很红咯!”。随即,记者们哄围上去。

王赛芝宣称她是刚载朋友回马华公会总部取车,顺便看一下这个请愿运动的情况,尤其是看是否有人要传交备忘录给马华公会的宣传局。

王赛芝表示,这些年轻人参与请愿运动对马华公会而言是一个很好的现象,只是参加的人比预料中少。她欢迎在场还没有加入马华公会的年轻人加入马华公会,并宣称已经为他们准备了一些表格。

纹身大汉突然拉起布条

王赛芝在记者的追问下,也承认了在下午五时至六时间,曾与其他六七位中委和总会长翁诗杰进行交流,要求翁诗杰重委马华公会妇女组主席周美芬为会长理事会成员。她预料翁诗杰将在明天给予他们一个答复。

她说:“我们当然尊重党章第46条文赋予总会长的权力,有权委任会长理事会的成员,但是我们也希望他能够再三考虑委任妇女组主席进入会长理事会。”

王赛芝离开不久后,约8时40分的时候,马华公会大厦前的另一个角落有几个纹身的大汉突然拉起两幅巨型布条,写着:“无耻之徒霸署理,马华永无翻身日”、“党魁诚信两丧失,华社颜面不复存”。

然而,在他们的布条还未完全摊开前,在旁的警员们马上上前去没收这些布条,并给予警告,双方随即展开了短暂的口水战。

这场静坐祈祷会结束以后,一些仍留在现场的参与者以个人身份向记者表示,他们对马华公会的内斗已经到了忍无可忍的地步,他们呼吁再举行特大或重选中委,以示民主。

当场宣读的“守护马华公会民主,坚持创党初衷”声明的完整内容如下:

下个月13日,就是马华公会创党元老敦陈祯禄的公祭纪念日。

在面向敦陈之前,我们这一批马华公会的普通党员,以及关心马华公会的热心人士,来到这里表达我们对马华公会民主体制的关切,和沉痛。

马华公会是为了什么而存在?敦陈祯禄是为了什么而要开创马华公会?

是为了国家,是为了民族。当年敦陈还有其他华社的先贤设立马华公会,不应该是为了个人的权位,或者名誉。马华公会的创党宗旨,是要保护国家的民主制度!

当然,60年创党至今,马华公会也曾经在执政过程中犯错。但是最重要的是,马华公会不能忘记我们的政治初衷。我要重复:不是个人的权位利益,是民族,是国家。

是什么确保马华公会不会走错?是什么让马华公会在犯错后,有机会重新来过?那应该是马华公会的体制。一个奉行了60年,而且一直以来都被细心守护和不断努力改进的民主体制。

马华公会不能不相信民主。因为如果马华公会自己也放弃民主,其他的人民凭什么相信,马华公会会推动国家的民主化?

如果马华公会的领袖为了权利斗争,竟然可以把党的这个根本体制踹在脚底下,任意扭曲;您要怎么让华社相信,在权位和利益当前,您不会背弃族群和国家的利益呢?

不幸的是,从双十特大风波开始,这一切正在发生着。马华公会在大部分人民眼中,信誉和党格已经将近破产。马华公会已经成为了社会大众的笑柄。

各位,我们只是普通党员。有人说,党员要成为政党的良心。我们不希望得到些什么,我们只希望尽自己的一点点责任,呼吁党领袖:请您帮个忙,请救救我们的党格。

各位,我们不想卷入任何派系之争,纯粹只想制造一个平台,让爱党的同志和朋友们,齐聚一堂,一人一把烛光,汇聚成党内民主的光芒;一人一份祈祷,旦愿马华公会早日走出乱局纷扰。
我们呼吁:领袖们,请尊重民主制!只有这样,马华公会才能得到社会的尊重。

守護馬華民主燭光會逾60黨員出席 (China Press - 20.11.2009)

逾60名馬華黨員及支持者聚集在馬華總部,哀悼馬華民主死亡。

逾60名馬華黨員及支持者,今晚聚集在馬華總部門口參與30分鐘的“守護馬華民主燭光靜坐祈禱會”,以哀悼馬華民主死亡。

這群人皆身穿黑衣,于今晚7時20分開始紛紛抵達馬華總部,出席者以馬華年輕黨員為主,包括馬青中委張盛文、前總會長丹斯里黃家定的新聞秘書吳健南、高教部副部長何國忠的新聞秘書李榮健、馬華婦女組主席周美芬的新聞秘書蔡風鈴及馬華部落客劉振國等。

主辦單位一名發言人是馬華黨員兼律師賴志豪,惟他拒絕透露本身是來自哪個區會,他強調,現場發表的聲明並不代表出席者立場。

祈禱會未開始,賴志豪就遭到在場駐守的警方警告,聲稱馬華大廈屬于私人產業,不允許非法集會。賴志豪回答,他是馬華黨員,將會在現場逗留到晚上9時。

舉手宣誓

最終警方要求眾人在8時20分必須和平解散,在答允后聚會者首先禱告30秒,高唱國歌和馬華黨歌,接著舉起右手宣誓。

賴志豪堅稱,今晚集會是要向馬華領導層傳達關切馬華民主體制的訊息,並非是為了支持任何一方派系。

在聚會開始前,馬華大廈鐵柵半關閉並有數位守衛留守,在7時45分,聚會者開始坐在門口地上。

現場也發表了一項聲明,還有一名年老長輩在現場派發題為“分析馬華危機”英文傳單,集會在晚上8時23分結束。

8時45分,突然有數名男子拉起兩條橫幅,寫著“無恥之徒霸署理,馬華永無翻身日”及“黨魁誠信兩喪失,華社顏面不復存”,並附上總會長拿督斯里翁詩傑及署理總會長拿督斯里蔡細歷被打叉的照片。

More than 70 people - in two separate groups - protested in front of the MCA headquarters today to vent their anger against the latest developments which had plunged the party into further crisis.

The protest came in the wake of the removal of Youth and Wanita wing heads - Wee Ka Siong and Chew Mei Fun - from the party's powerful presidential council, which oversees implementation of party policies, yesterday.


The protest started at about 7.50pm when the first group, consisting of youths mostly, began converging at the doorsteps of the building in Jalan Ampang and started offering a 30 second silent prayer to "safeguard MCA's democracy".


The group, mostly in black, then gave a rendition of the national and party anthem, followed by staging a 20-minute sit-in with candles, while listening to group leader Monna Ong deliver her speech.


"MCA must believe in democracy because when MCA is void of democracy, how can we convince the public that MCA will promote and enhance democratisation of the country," she asked.


She said democracy was the cornerstone of the party, and if betrayed for the sake of retaining power, the party would lose the respect and support of the Chinese community.


'Respect EGM results'



The speech, which did not target any person or group, also said that the party leadership's disregard of the Oct 10 extraordinary general meeting resolutions has severely damaged the party's reputation.


"Sadly, since the Oct 10 EGM, this is what that has been happening. In the eyes of the people, MCA's dignity and reputation is almost gone. MCA is now seen as a joke to the public," she added.


After the short speech, the group continued their sit-in and dispersed without any incident at about 8.20pm.


One of the participants, Lai Chee Hoe, said he attended the protes because, as an MCA member, he was very sad with the current state of party affairs.


"Our emphasis is democracy and that the voices of the delegates (during the Oct 10 EGM) must be respected for democracy to prevail," said Lai, a practising lawyer.


He said president Ong Tee Keat has a moral obligation to step down from his post after losing a no-confidence vote on Oct 10, as he had promised to step down should he lose "even by one vote".





Likewise, he said deputy president Dr Chua Soi Lek should respect the delegate's decision not to approve a resolution to reinstate him to the post during the same EGM."We want the party leaders to respect democracy. We don't want to see a repeat - where voices of the central delegates (through an EGM) are not respected and ignored," he added.


Heng jeered, Ong-Chua ridiculed


Following the candlelight vigil, MCA information chief Heng Sai Kee suddenly appeared from the party headquarters and was mobbed by the press.

This was met by jeers from unknown individuals at the scene.


"Heng Sai Kee! You are just here to make a scene! Now you are very famous," shouted one individual.

"Heng Sai Kee! You have everything now. What more do you want?" shouted another.

Heng told the press that she was on her way to her car and had come to meet the vigil participants.


"They are young people who are concerned with the party. This is a good sign. Usually, young Chinese are very cold towards politics," she said.


As Heng left the scene, a small commotion broke out when another group of youths unfurled several banners condemning Ong and Chua.

The posters, all bearing crossed-out pictures of Ong and Chua, were immediately confiscated by the police.

However, the group of 13 people came prepared with paper handouts of the posters which was quickly distributed to the press.


"The shameless person is hanging on as deputy president. Now MCA cannot revive itself" read one poster.


"The party president has lost trust and credibility. The Chinese community has lost face," read another.


'Nab Chua for oral sex'

Spokesperson for the second group Bryan Teoh said his group were not MCA members, stressing that they were neutral in the party conflict, but were concerned with party developments.


He said his group felt the party leaders had disgraced the Chinese community because they cannot be held accountable to their words.


"They mobilised everyone, more than 2,000 people, to Kuala Lumpur for an EGM (on Oct 10) and spent RM700,000. But their voices were all disregarded," lamented Teoh.
He stressed that he was Hainanese, like the party president, and he felt that his clan had been embarrassed by recent events.


He said the party must keep its house in order in order for the young to have confidence in the party and eventually lend their support.


Turning his attention to Chua, Teoh said the deputy president was morally tainted by the sex DVD scandal and should not hold on to his post.


"People are asking me if oral sex is legal in this country. If not, why is there no action taken against him? If everyone can practice oral sex, then Malaysia has no laws!" he said.

About 40 police officers stood watch during the entire proceedings. There were no arrests.

KUALA LUMPUR: Suasana di hadapan bangunan Wisma MCA semalam, kecoh apabila beberapa kumpulan dalam MCA berkumpul beramai-ramai bagi melahirkan bantahan dan rasa tidak puas hati dengan keputusan Presiden MCA, Datuk Seri Ong Tee Keat yang merombak Majlis Presiden parti itu, kelmarin.
Kira-kira 70 ahli dan penyokong Pemuda MCA berkumpul secara aman dan menyalakan lilin pada perhimpunan bermula sekitar jam 7.30 malam itu bagi meluahkan pendapat mereka mengenai tindakan terbaru pucuk pemimpin parti terbabit.
Perhimpunan itu bagaimanapun ditamatkan selepas sejam atas arahan polis dan sejurus ahli serta penyokong MCA mula mengeluarkan sepanduk yang mendesak kedua-dua pemimpin atasan parti itu meletak jawatan.
Seorang ahli MCA yang mengetuai perhimpunan itu, Lai Chee Hoe, berkata pihaknya mendesak demokrasi dikembalikan dalam kepemimpinan MCA.
Sementara itu, Ketua Setiausaha Wanita MCA, Senator Heng Seai Kie yang ditemui, berkata ahli MCA sudah mencadangkan kepada Ong bagi memasukkan semula Ketua Wanita, Datin Paduka Chew Mei Fun dalam Majlis Presiden.

聚会者开始时为马华进行祷告30秒钟,高唱国歌和马华党歌,接着举起右手宣誓。

不堪警告被迫提前收场


现场大约有30名警员驻守旁观。马华中央党部铁栅在聚会开始前也呈现半关闭的状态,门前也有数位守卫站岗戒备。


一名来自金马警区的警官亦警告赖志豪,声称马华大厦属于私人产业,不允许非法集会。不过,赖志豪却回答说,他是马华党员,将会在现场逗留到晚上9点。


尽管今晚的集会被视为倾向廖派,抗议马华当权派不尊重民主体制,但赖志豪却坚称,今晚集会的目的是要向马华领导层传达关切马华民主体制的强烈讯息,并非是为了支持任何一方派系。




男子派发抨击翁诗杰文章


此外,上次11月3日马华中委会会议,出现马华中央党部外派发《星洲日报》抨击翁诗杰是“马华史最糟糕上总会长”特稿的中年许姓男子,今晚再次出现在集会上派发一样的文章。对此,赖志豪强调,这并非是主办单位所派发。



聚会者随后在晚上8点05分左右,开始静坐在马华大厦前的空地,但警方却再次命令他们必须在8点20分就结束集会。尽管主办单位早前扬言,集会将在晚上9点才结束,不过最终在警方的严厉警告之下,却不得不在8点17分提前收场。



王赛芝:关心马华是好事



不过,新任马华新闻局主任王赛芝,却在集会结束后才突然现身,并声称本身是过来看看,究竟有没有备忘录需要接收。


她一出现就引起媒体的骚动,还未来得及与集会参与者产生任何互动,就被记者团团包围,导致有人突然高嘘道“王赛芝来做戏!”以及“王赛芝很红咯!”。


这名妇女组总秘书解释说,妇女组成员刚从一个地方回来,她是送其同事回来拿车,因此就顺便过来看看。她表示,她之前已经交待新闻处准备食水给参与集会者。


询及对今晚的烛光晚会的看法,王赛芝则淡然地表示,“年轻人关心马华是很好的现象,因为我们华裔子弟都对政治很冷感”。


她欢迎今天的集会者若还不是马华党员,就应该加入马华。不过,她也指出,今晚的参与者不必想象般这么多。


要翁蔡尊重双十特大议案


针对今晚的烛光晚会,翁秀秀较后也向媒体指出,这是一群关心马华的党员和朋友要请愿,带出他们要求民主的心声。


赖志豪则表示,作为马华的党员,他对该党的情况感到非常伤心,“我们的诉求是民主,代表(在双十特大)的心声应该获得尊重”。


他指出,总会长翁诗杰在不信任动议通过后已经拥有道德义务辞职,因为他曾答应就算是输一票也要辞职。基于同样的原因,他也认为,署理总会长蔡细历应该尊重代表拒绝批准恢复其党职的决定。


“我们要党领袖尊重民主,我们不要看到党中央代表的心声再度不受尊重,以及被忽视。”


另一组集会者两度举布条被没收


不过,当黑衣持蜡的静坐集会解散之后,却发生有另一组不知名的集会者尝试高举布条,却被警方两度阻止没收的插曲。



他们明显是反对翁诗杰和蔡细历的人士。他们持着的两张布条写着“无耻之徒霸署理/马华永无翻身日”及“党魁诚信两丧失/华社颜面不复存”的字眼,布条的左右两旁甚至附上翁蔡被打叉的照片。





此外,也有两个人高举大字报,上面贴着翁诗杰的一张大型海报,斜写着“超越法律”的字眼(above the law)。






虽然这批集会者两度尝试举起布条,不过警方在瞬间就强行没收。







痛批翁诗杰及蔡细历道德污点


这一批集会者的发言人张布赖恩(Bryan Teoh)较后受询时强调,他们纯粹是关心马华发展的公众人士,并非党员。此外,他们也采取中立的立场。


他认为,马华领袖已经辜负了华社的期望,因为他们无法遵守承诺。



“他们在双十特大当天动员超过2000名代表到吉隆坡,并且花费70万令吉,但是这些代表的声音却被忽视。”


他表示,本身是和总会长一样是海南人,他认为总会长的行为已经沾污了其籍贯。


他也将矛头指向蔡细历,表示后者因为性爱光碟丑闻而出现道德污点,因此不适合担任署理总会长。


“人们问我,口交在这个国家是不是合法?否则,为什么没有采取行动对付他?如果每个人都口交,大马就没有法律。”


王赛芝:妇女组要求重委周美芬

另一方面,王赛芝受询时也披露,妇女组中委今日已经会见翁诗杰,要求后者重新考虑委任妇女组主席周美芬进入会长理事会。她表示,总会长预料将在明天做出一项宣布,不过她却不愿披露其内容。

翁诗杰是昨日中委会会议后“大开杀戒”,宣布将周美芬、马青总团长和另外7名廖派大将开除出会长理事会,导致两大臂膀之首在历史上首次被排除在马华这个重要的机构之外。针对这项出人意表之外的发展,妇女组署理主席尤绰韬今午也召集中委们举行紧急会议。

王赛芝透露,妇女组在昨天消息公布后,就已经和总会长约定一个时间会面。他们在今午开会后,也在5点前往会见总会长表达他们的意愿。

Student protesters call for 'democracy' in MCA (The Edge - 20.11.2009)

KUALA LUMPUR: In a rare show of dissent, a small group consisting of mostly students held a candlelight vigil at the MCA headquarters here last night.
Numbering around 60, the demonstrators held candles and sang for over an hour before they were dispersed by the police.
According to the group's spokesperson Lai Chee Hoe, who declined to say which division he is from, the vigil was to express their disappointment over the latest happenings in MCA.
"We are a group of people who are very disappointed with what has happened in MCA. We are not aligned to any faction. We want the MCA leaders to respect democracy," said Lai.
Lai, however, declined to elaborate what "respect democracy" meant.Apart from the confiscation of several banners by the police, the demonstration was a non-event.
The banners bearing pictures of MCA president Datuk Seri Ong Tee Keat and his deputy Datuk Seri Dr Chua Soi Lek said the two had caused the community to lose credibility and the party cannot be rejuvenated with the two as its leaders.
It also said Chua was shameless to hold on to the deputy president's position.
Another MCA member, Chong Sin Woon, who claimed that he is from the Pandan division, said that fresh polls were necessary to restore confidence in the party.
"The leaders should respect the decision made by the Oct 10 extraordinary general meeting," he added.

Two Wings and prayers, but no big guns at MCA ‘outsiders’ vigil (Malaysian Insider - 20.11.2009)

Youngsters behind face masks. — Pictures by Jack OoiKUALA LUMPUR, Nov 19 — The word on the street was that a protest was going to be held at the MCA headquarters at Jalan Ampang. Reporters came in droves at 7pm. Policemen prepared for any eventuality.



What was hyped as a “protest” against the MCA leadership, turned out to be a subdued affair. For one thing, the protestors were mostly youngsters wearing face masks. Pockets of the MCA Youth and Wanita wings’ members attended, but no big names showed up.



“If an MCA leader were to betray and manipulate democracy, the very foundation of the party, just for the sake of retaining power, how can you convince the Chinese community that you will not betray the nation and country when you are facing the temptation of power and personal interest?” asked Lai Chee Hoe, a lawyer who was the appointed spokesman for the night.



He read out the press statement in front of the 60-odd crowd who were dressed in black and holding candles. A rendition of the Negaraku plus the MCA party anthem soon followed suit.



“We are here not in support of any faction... We hope MCA will end this turmoil and regain stability in time to create a better tomorrow,” said Lai, who stressed that the candlelight vigil was not aimed at furthering any political agenda and that all they wanted was a strong MCA.



Chong Sin Woon, MCA Youth CC member for Pandan, attested to the fact that most of the people who attended the vigil were “outsiders”.



“This vigil was mostly initiated by outsiders, young people who are concerned with the future of this party. Now we ask MCA leaders to listen to these young people because of they do not do that, MCA is gone.”

The only excitement in an otherwise sombre affair. He went on to emphasise that the only possible way to realise democracy in the party was to make way for fresh elections.



The candlelight vigil reached its peak moment when people started offering “prayers” for MCA. The youngsters, though seemingly nervous, carried out what they came for.



Aside from the vigil, the only highlight of the evening was when a few people started brandishing anti-Ong Tee Keat/Chua Soi Lek banners.



The banners read in Chinese: “Chua Soi Lek keeps hanging on to deputy post, MCA cannot be rejuvenated with this person in power.



“Party chief Ong Tee Keat loses trust and credibility, has caused the Chinese community to lose face.”



No arrests were made. The banners were taken away by the police. The gathering ended at 9pm.

將成立論壇解決問題‧黨團青年對話達共識 (Sin Chew-15.11.2009)

吉隆坡)來自各政黨的青年團及青年組織代表,今日(週六,11月14日)在律師公會青年律師委員會主辦的,締造更美好的馬來西亞青年對話會中達成成立論壇的共識。



律師公會青年律師委員會主席賴志豪說,這次對話會是個良好的平台,讓來自國陣與民聯的青年團及青年組織對課題進行討論,並尋求解決方案。


“週六只是一個開始,日後新成立的論壇,將繼續鼓勵青年團體對各種課題展開討論。”


馬青、民青團、公青團、社青團、人民進步黨青年團和動力青年的代表,在長達1小時45分鐘的對話會,討論有關種族課題及探討針對單一源流學校的意見。


行動黨副宣傳秘書張念群指出,各代表對單一源流學校存有不同的見解,大家都能提出本身的看法。


她說,任何政策不應以種族作為出發點,雖然週六討論的課題,不會立即就在週一(11月16日)成為政策,但青年將是日後的決策人,有個共同努力的平台。


出席對話會者包括公青黨副團長法立、中委林秀玲、馬青中委許勝傑、聯邦直轄區法律局成員王威稂、人民進步黨青年團副團長哈力、動力青年代表盧傳文及李凱倫。

为更好的马来西亚青年领袖对话会 一线领袖没出席失看头 (Kwong Wah - 15.11.2009)

(吉隆坡14日讯)吉隆坡律师公会青年律师委员会举办“为更好的马来西亚青年领袖对话会”,原是让各朝野政党青年团领袖聚集讨论国内社会课题,可惜多数一线领袖皆没出席,失去精彩看头。

吉隆坡律师公会青年律师委员会主席赖志豪表示,这次的对话会主要是找个机会,让国阵和民联的青年团建立一个沟通的平台,针对国内的时事课题,进行讨论和想出解决方案。

他说,各政党代表们可以在对话会上,放下政治立场,发表自己对国内时事课题的看法。“1小时40分钟的对话会原本是要讨论6项议程,当中包括民族关系、内安法令、双党合作、社会基本自由、国会改革和国家前景的课题,很可惜,由于时间关系,大家只能完成第一项民族关系的课题。”

他希望能在下一次会议完成其余的5项议程。他也透露,各朝野政党的代表也一致同意举办一个论坛,让更多人能够透过论坛发表自己对国家课题的意见。

马青中委许胜杰和马青联邦直辖区法律局成员王威稂则代表马华出席,其他政党代表包括人民进步党青年团代表嘉玛鲁丁古拉汉、公正当青年团中委林秀凌、法里滋、动力青年(Youth 4 change)召集人李凯伦和卢传文。巫青团团长凯里和国大党青年团T莫汉则缺席,也没有委派代表出席。

单一源流学校 朝野意见不一

近日来备受国人所关注的单一源流学校课题,也是今日在对话会上讨论的课题之一,来自朝野政党青年团代表皆对此课题各有不同意见。

行动党副宣传秘书兼沙登国会议员张念群不认同实施单一源流学校,她是代表行动党社青团总团长陆兆福出席今次的对话会。

她说,行动党的立场,是单一源流学校政策无助于国民团结,虽然如此,他们并没有反对其他支持此政策的领袖发表他们的意见。

她认为,政府所实施的各项政策,不应从种族角度出发,国家的政策须以人民利益为主。通过今次对话会,让个朝野政党青年团领袖公开讨论自己的意见,拉近彼此之间对相关课题的分歧,一起为国家未来努力。

另一个支持单一源流学校政策的是人民进步党青年团代表嘉玛鲁丁古拉汉,他认为,单一源流学校能够促进国民团结。

他在记者会上指出,这是其中一种方法,让各族学生有机会在一个环境,共同学习彼此了解。

另一方面,动力青年召集人李凯伦也表示,希望代表们能把今次的对话会的结果,传达给母体知道,拉近两者间的了解,以便在共同解决国家课题上,能够更顺利地完成。

ROS decision wrong, MCA CC decision stands (Malaysiakini-9.11.2009)

I refer to the Malaysiakini report Chua is deputy president: ROS shocker.It is disheartening to see a deputy president of the MCA resorting to pleading the Registrar of Society to reinstate him in his position. This is short of getting external forces to meddle in MCA's affairs. I will now explain why the decision of ROS is wrong and not in accordance with the constitution of the MCA.
Firstly, let me quote the letter of reply from ROS. The grounds of reinstatement by ROS states:
'Jabatan ini berpendapat bahawa tidak berlaku kekosongan jawatan Timbalan Presiden MCA memandangkan keputusan resolusi Mesyuarat Agung Luar Biasa (EGM) MCA pada 10hb Oktober 2009 tidak memenuhi keperluan dua pertiga (2/3) majoriti seperti yang diperuntukkan di bawah Perkara 35 Perlembagaan MCA'.
The basis of reinstatement by ROS was that Article 35 of the MCA constitution stipulates that the general assembly may dismiss any party official if approved by at least two-thirds of the delegates. The ROS's grounds appear to suggest that since this two-thirds was not achieved in removing the deputy president, he should remain in office and the results of the EGM should be overturned.
With all due respect to the decision, the ROS fails to grasp that the deputy president was not removed by the general assembly in the EGM conducted on Oct 10 but was instead removed by virtue of the MCA presidential council adopting the findings of the MCA disciplinary board and thereafter having his membership suspended by the MCA central committee.
If the motion to reinstate him was not carried, the decision of the central committee still stands and he should abide by the decision of the central committee.
Article 125 allows the disciplinary board to report to the presidential council and Article 128 provides that the decision of the central committee on matters of discipline shall be final and conclusive.
In this regard, since the motion to reinstate Chua at the Oct 10 EGM wass not carried, the results of the EGM have had no impact on the decision of the central committee, which in any event, is final and conclusive.
As a senior party leader, Chua should have an in-depth understanding of the constitution and not further confuse the public by filing an appeal to the ROS. We need leaders who have integrity and not those who would do anything just to cling on power.

遇攫匪最好報案‧律師:動武或被控 (Sin Chew-6.11.2009)


(雪蘭莪‧八打靈再也)吉隆坡青年律師公會主席賴志豪勸請公眾在遇到攫奪匪,本身又沒受到生命威脅的情況時,最好的方法是向警方報案,以避免追匪而釀成不幸事件。

他說,在法令下,即使其中一方犯錯,任何人都不可以擅自奪走另一個人的生命,除非是在自衛
他解釋,所謂的自衛是,受害者在匪徒亮刀或亮鎗的情況下,或在生命受到威脅下使用合理的武力反擊是可以被接受的;相反的,受害者在不合理的情況下使用不合理的武力,導致對方生命受威脅,就會反被控告。

他週四(11月5日)受詢時向《星洲日報》說,發生攫奪案時,受害者最好直接向警方報案,不要用自己的生命與匪徒對抗,因為這可能導致自己或其他人的生命受威脅。

“受害者上庭時面對的另一個問題是很難找到證人證明自己所處的情況,因為這些證人通常是素未謀面的公眾人士,即使是登報尋找證人也沒人會理會。況且,大多數的過路人都不瞭解實際的情
況。”

優異生溺斃泳池‧律師:須視當時情況‧家屬討公道須確定數元素 (Sin Chew 24.9.2009)

(雪蘭莪‧八打靈再也)泳池溺斃案家屬在通過法律討公道前,必須視個別情況而定,包括是否涉及個人疏忽、泳池狀況及案發時的情況。

律師公會青年律師委員會主席賴志豪表示,死者家屬可提出控訴,但事前必須確定起訴的元素。
他週三(9月23日)針對9歲男童參加同學生日會時溺斃泳池後,死者父母擬通過法律討公道受詢時,發表談話。

他說,男童家屬在上述個案中可對公寓管理層及家長提出控訴,惟必須確定幾個元素包括當中是否存疏忽成份、男童是否受邀出席生日會及泳池開放時間等。

此外,前律師公會主席楊映波建議死者家屬尋求律師的援助,因為這些案件必須視當時的情況定奪。

楊映波以酒店泳池溺斃案舉例說,溺斃案家屬必須掌握幾個要素,包括泳池開放時間、救生員執勤狀況等再討公道。

彭運明:家長須負責安全校外聚會須成人監督

全國國民型華文中學校長理事會主席彭運明表示,家長在校外範圍邀請孩子的同學參加私人聚會時,至少必須有成人在旁監督,以防萬一。

他說,主辦學生私人聚會的家長有必要對受邀學生的安全負責,尤其小學生安全問題更是不可忽視。
